Terms of Service

1. Introduction

These Terms of Service ("Terms") form a legally binding agreement between you and NIMUGIRE Business Ltd ("MotoLink", "we", "us", "our"), a company registered in Rwanda under the Rwanda Development Board (RDB). MotoLink Rwanda is a technology platform — available at motolinkrwanda.com and via the MotoLink mobile apps — that connects riders with independent moto-taxi drivers in Kigali, Rwanda.

By registering for an account, accessing the platform, or requesting a ride, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Eligibility

• You must be at least 18 years old to use MotoLink.
• You must hold a valid Rwandan phone number to create an account (phone OTP is used for authentication).
• Driver applicants must hold a valid Rwandan driving licence, valid moto-taxi permit, roadworthy motorcycle, and provide truthful identity documents during onboarding.
• You may not create an account on behalf of another person without their express consent.

3. The MotoLink Service

MotoLink is a technology intermediary, not a transport operator. We provide software that enables riders to request moto-taxi trips within Kigali and enables independent drivers to accept those requests. The transport service itself is provided by the individual driver, who is an independent contractor — not an employee or agent of MotoLink.

The platform currently covers Kigali only. Inter-city trips, goods delivery, and subscription plans are not offered in this version of the service.

5. Driver Terms

• Drivers are independent contractors. Nothing in these Terms creates an employment, partnership, or agency relationship between a driver and MotoLink.
• Drivers must maintain valid documentation (driving licence, moto-taxi permit, vehicle registration, and insurance) at all times while using the platform.
• Driver earnings accumulate in the MotoLink in-app wallet.
• Payout minimum: Withdrawals (cashouts to Mobile Money) require a minimum balance of 10,000 RWF. Cashout requests below this threshold are not processed.
• Nightly automatic payouts are run daily at approximately 22:00 UTC for drivers whose wallet balance meets the minimum threshold.
• MotoLink reserves the right to suspend or permanently deactivate a driver account for repeated cancellations, safety violations, fraudulent activity, or failure to maintain valid documentation.

6. Cancellations

• Rider cancellations: Riders may cancel a booking before the driver arrives. Cancellations made after the driver has started travelling to the pickup point may incur a cancellation fee. The applicable fee (if any) will be shown in the app before confirming cancellation.
• Driver cancellations: Drivers who repeatedly cancel accepted rides may have their account restricted.
• MotoLink does not guarantee the availability of a driver at any given time or location.

7. Safety & Disclaimer

MotoLink is a ride-hailing service, not an emergency service. If you are in danger or require urgent assistance, call 112 (Rwanda National Police emergency line) immediately.

• All riders must wear a helmet provided by the driver. Refusing to wear a helmet is grounds for the driver to decline the trip.
• Riders and drivers are expected to treat each other with respect. Verbal or physical abuse, discrimination, or harassment is strictly prohibited and may result in account suspension.
• MotoLink conducts background checks and document verification for drivers during onboarding, but cannot guarantee the conduct of any driver or rider during a trip. Users travel at their own risk.
• MotoLink is not liable for accidents, injuries, theft, or loss of property occurring during a ride. We strongly recommend riders carry personal travel insurance.

8. Account Deletion

You may request deletion of your MotoLink account at any time:

• Via the Delete Account page in the app or on this website.
• By emailing admin@motolink.rw with the subject line "Account Deletion Request".

Account data will be deleted within 30 days of the confirmed request, subject to legal retention requirements (e.g. financial records required by Rwandan tax law may be retained for up to 5 years). Outstanding wallet balances for driver accounts will be paid out before deletion, provided the minimum payout threshold is met.

9. Privacy

Your use of MotoLink is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data under Rwanda's Law No. 058/2021 on the Protection of Personal Data and Privacy. By using MotoLink you consent to the practices described in that policy.

10. Prohibited Conduct

You agree not to:

• Use MotoLink for any unlawful purpose.
• Create fake accounts, manipulate ratings, or submit false information.
• Attempt to access, tamper with, or disrupt the platform's systems or data.
• Use the platform outside Kigali for inter-city transport or goods delivery.
• Solicit drivers or riders to complete trips outside the platform to avoid platform fees.

11. Limitation of Liability

To the maximum extent permitted by Rwandan law:

• MotoLink provides the platform "as is" and makes no warranty that it will be uninterrupted, error-free, or available at any particular time.
• MotoLink is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform.
• MotoLink's total liability to you for any claim shall not exceed the fare paid for the specific ride giving rise to the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Last Updated" date and, where the changes are material, notify registered users by SMS or in-app notification. Continued use of MotoLink after the effective date of any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Rwanda. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rwanda.
